Miscellaneous Application / Ruling

  1. 1 Whether the application challenging the Registrar's warrant of attachment and sale is proper before this Court.
  2. 2 Whether the warrant of attachment and sale of the property can be varied to substitute the property for another.
  3. 3 Whether the property attached is matrimonial property and protected from execution.

Ratio Decidendi

The application is not proper before the Court as the correct procedure for objecting to the attachment and sale of property in execution is through objector proceedings under Order 22 rule 55 of the Civil Procedure Rules, not by appeal under Order 50 rule 8. The Applicant failed to adduce sufficient evidence to prove that the attached property is matrimonial property protected from execution. The property was pledged as security for the loan and the Applicant cannot challenge its attachment after benefiting from the loan. The Registrar's orders stand, and execution should proceed. Costs are awarded to the Respondent due to the Applicant's conduct in prolonging litigation.
