Ratio Decidendi

The Tribunal found that the applicant was served with the objection decisions in May 2019 and, under the applicable statutory provisions, was required to file its application within 30 days of service. The application was filed on 5th July 2019, which was outside the prescribed period, rendering it time barred. The Tribunal further held that the second respondent, Equity Bank, acted as an agent under the authority of the taxpayer and the Uganda Revenue Authority in executing the agency notice, and as such, could not be sued by the applicant where the principal was known and disclosed. The Tribunal upheld both preliminary objections and dismissed the application with costs.
