The evidence established that the suit land originally belonged to the estate of the late Antonio Kiiza, who distributed it among his beneficiaries, including the Respondents and Bahandagana, the Appellants' father. The Appellants' land, characterized by tea growing, was found intact and not interfered with by the Respondents. There was no credible evidence of encroachment or trespass by the Respondents. The sole ground of appeal was therefore devoid of merit, and the findings of the trial Magistrate were upheld.
