The Minister of Trade, Industry and Cooperatives acted ultra vires in banning the importation of fishing gears, as the statutory authority to regulate fishing and related imports lies with the Minister of Agriculture, Animal Industry and Fisheries under the Fish Act. The decision was not based on any enabling legislation and was therefore illegal. The purported reliance on a presidential directive was misplaced, as the directive did not authorize a blanket ban but called for legislative amendment and targeted action against illegal fishing.
