The notice of appeal was lodged out of time, and no leave had been granted for extension of time to appeal when the application for stay was made. The court held that the grounds for stay are contingent upon a pending competent appeal, which was absent. The affidavit in support was found not to be defective as it was sworn in the applicant's own capacity and did not purport to represent others without written authority.
