Ratio Decidendi

The Court of Appeal found that the High Court properly evaluated the evidence and correctly held that the respondent was not a trespasser. The sale agreement, although written, was orally amended by mutual consent to compensate the respondent with part of plot 15 for the deficiency in plot 17, which had been sold to a third party. The appellant was aware of the foundation on plot 17 belonging to Idd Banange and agreed to make up the respondent's entitlement from her own land. The oral amendment was supported by witness testimony and was enforceable. The District Land Tribunal's decision was rightly set aside, and the respondent's occupation was lawful under the amended agreement.
