Ratio Decidendi

The appellate court found that the trial Chief Magistrate properly evaluated the evidence regarding ownership and boundaries of the suit land, followed correct procedure at the locus in quo, and did not contravene Order 21 Rule 4 of the Civil Procedure Rules. The appellants failed to prove ownership or establish any procedural irregularity that would warrant overturning the decision. However, the respondent, having been found not to be a trespasser and having incurred costs in defending the suit, was entitled to costs, and the trial Chief Magistrate erred in denying them without justification. The appeal by the respondent on costs succeeded, while the appellants' appeal was dismissed.
