The Supreme Court, per Tsekooko JSC, held that election petition appeals to the Supreme Court are governed by the Parliamentary Elections (Election Petitions) Rules (SI 141-2) as preserved by Section 101(3) of the Parliamentary Elections Act, 2005, and that, by virtue of Rule 36 of SI 141-2 and Section 93(3) of the Act, the Supreme Court Rules also apply with necessary modifications.
