Ratio Decidendi

The High Court found that the appeal was incompetent as it was filed without the requisite leave of court, contrary to the Civil Procedure Rules and the Magistrate's Courts Act. The LCIII Court of Nyakishenyi acted without jurisdiction, as there was no valid appeal from the LCII Court, rendering its proceedings and judgment null and void. The Chief Magistrate erred in ordering execution of the LCIII Court's judgment, which was based on a nonexistent appeal. The only valid judgment was that of the LC1 Court of Kijubwe, which was never set aside and thus remains undisturbed. The appeal was dismissed, the Chief Magistrate's decision set aside, and costs awarded to the respondent.
