The court found that the applicant's non-appearance on 11.4.2024 was due to a genuine miscommunication by the court clerk, which constituted sufficient cause for reinstatement of the dismissed application. However, upon reinstatement, the court determined that the application to transfer the suit from the Chief Magistrate's Court to the High Court was moot because the Chief Magistrate had already transferred the suit by order dated 25.10.2023. As such, the relief sought had already been granted, and the application served no practical purpose.
