Ratio Decidendi

The court found that while there existed a lawful temporary injunction order issued on 1st September 2020 and that all parties had knowledge of it, the applicants failed to provide clear and convincing evidence that the respondents disobeyed the order. The photographs submitted did not indicate when or where they were taken, nor did they conclusively show that the alleged acts of demolition, eviction, or exhumation occurred after the issuance of the injunction or on the suit land. The court held that, in the absence of such evidence, it could not be established beyond reasonable doubt that the respondents were in contempt of court. Consequently, the application for contempt failed.
