Procedural Posture

Miscellaneous Application / Ruling

  1. 1 Whether the application raises sufficient grounds for granting a temporary injunction order.
  2. 2 What remedies are available to the parties.

Ratio Decidendi

The court found that the status quo intended to be preserved by the temporary injunction had already been tampered with, and the applicants did not seek leave to amend their pleadings or file supplementary evidence to support restoration of the status quo. Given the lapse of time since the application was filed in 2017 and the main suit already set for hearing, the court held that the application lacked merit. The principles for granting a temporary injunction require a clear status quo to be maintained, which was not established in this case. Consequently, the application for a temporary injunction was dismissed.
