The Supreme Court held that since the Notice of Appeal and the appeal were filed out of time and all efforts to validate them were unsuccessful, the respondent's subsequent withdrawal of the appeal without the applicant's consent triggered Rule 90(4). Under this rule, the appeal stands dismissed with costs to the applicant. The court found Rule 78 inapplicable because the appeal had already been withdrawn prior to the hearing of the application. The applicant was therefore entitled to costs of the withdrawal and half the costs of the application.
