Criminal Appeal / Judgment

  1. 1 Whether the sentence of 18 years imprisonment for aggravated defilement was harsh and manifestly excessive in the circumstances.
  2. 2 Whether the trial judge properly considered all relevant mitigating and aggravating factors before passing sentence.

Ratio Decidendi

The Court of Appeal found that the trial judge had considered both aggravating and mitigating factors, including the appellant's age, plea of guilt, and time spent on remand. However, upon review of precedent and the circumstances, the court determined that the sentence of 18 years imprisonment was harsh and excessive. The appellant was a first offender, of youthful age, and had pleaded guilty. The court substituted the sentence with 15 years imprisonment, deducting the 11 months spent on remand, resulting in a final sentence of 14 years and 1 month to run from the date of conviction.

Orders
