Procedural Posture

Criminal Miscellaneous Application / Ruling on Bail Application

  1. 1 Whether the misnaming of the respondent renders the bail application incompetent.
  2. 2 Whether the applicant is entitled to bail pending trial under the relevant constitutional and statutory provisions.
  3. 3 Whether the applicant has satisfied the legal requirements for grant of bail, including assurance of non-abscondment and provision of sureties.

Ratio Decidendi

The court held that the misnaming of the respondent as the Directorate of Public Prosecutions instead of 'Uganda' was a bona fide mistake by a lay applicant and, in the interest of substantive justice, cured the error by substituting the correct party. However, the applicant failed to provide assurances that he would not abscond, did not attach proof of fixed abode, and named no sureties. Given the seriousness of the charge (aggravated robbery) and the absence of exceptional circumstances or sufficient guarantees of attendance, the court was not persuaded to grant bail. The application was therefore dismissed.

Court Disposition

application dismissed

Orders

  • The Directorate of Public Prosecutions is struck out as respondent and replaced with 'Uganda'.
  • Application for bail is dismissed.
