Procedural Posture

Civil Appeal / Appeal From Dismissal of Application to Set Aside Ex Parte Judgment

  1. 1 Whether the Deputy Chief Registrar had jurisdiction to enter ex-parte judgment for eviction and mesne profits under Order 9 Rule 6.
  2. 2 Whether the ex-parte judgment and subsequent execution orders were nullities due to procedural irregularity.
  3. 3 Whether satisfaction of the judgment and completed execution preclude setting aside a null judgment.

Ratio Decidendi

The Deputy Chief Registrar acted without jurisdiction in entering ex-parte judgment for eviction and mesne profits under Order 9 Rule 6. Such claims require a full trial under Order 9 Rule 8, including service of a hearing notice and adherence to ordinary procedure. The judgment entered was a nullity, and all subsequent orders and executions based on it are void ab initio. Satisfaction of the judgment and completed execution do not preclude the court from setting aside a null judgment. The appellants are entitled to restoration of possession and proceeds from the sale of their property.

Court Disposition
