Ratio Decidendi

The Court of Appeal held that its jurisdiction on a second appeal is strictly limited to questions of law, as provided by Section 72(1) of the Civil Procedure Act. The grounds of appeal raised by the appellants were found to be of mixed law and fact, not pure questions of law. The court emphasized that it cannot assume jurisdiction not vested in it by statute, regardless of the sensitivity of land matters in Uganda. The High Court had already thoroughly re-evaluated the key issues of registered title and unregistered customary interests. No injustice would result from dismissing the appeal without considering the merits, as the first appellate court had addressed the substantive issues....
