Miscellaneous Application / Ruling on Application to Set Aside Exparte Judgment and Stay Execution

  1. 1 Whether the exparte decree in Miscellaneous Cause No. 33 of 2022 should be set aside.
  2. 2 Whether an order for stay of execution should be granted.

Ratio Decidendi

The court found that although the applicant relied on the mistake and negligence of counsel as grounds for setting aside the exparte decree, the applicant also had a duty to follow up on the progress of their case with their advocates. The applicant failed to take proactive steps after the first lawyer's default and only sought to set aside the judgment eleven months after its delivery, which the court considered negligent and indolent. The court held that this was not a case where the mistake of counsel should be excused, as the applicant contributed to the delay and failed to demonstrate just cause for setting aside the exparte judgment. Consequently, the application was dismissed.
