Ratio Decidendi

The court found that the Applicant demonstrated, through affidavit evidence, that his previous counsel omitted material facts and claims necessary for the just determination of his case. The intended amendment does not introduce a new cause of action or substitute one for another, nor is it prohibited by law. The amendment will enable the court to fully and finally determine all questions in controversy and avoid multiplicity of suits. The application was not brought in bad faith and will not prejudice the Respondent. Therefore, the Applicant is entitled to leave to amend his written statement of defence and add a counterclaim.
