Although the applicant lodged a notice of appeal, he did not demonstrate a serious and imminent threat of execution, nor did he provide evidence of substantial loss that would result if the stay was not granted. The application was filed with unreasonable delay, and the security deposited was for costs of the appeal in the Court of Appeal, not for due performance of the decree as required.
