  2. 2 Whether the requirements under section 222 of the Succession Act for a limited grant have been satisfied.

Ratio Decidendi

The court held that before granting limited Letters of Administration under section 222 of the Succession Act, it must be established that the executor or person entitled to apply for administration is either unable or unwilling to act. In the present case, the applicant failed to identify or provide evidence regarding the person(s) who should have applied for Letters of Administration to the estate of the late Daudi Kiparu, nor did he demonstrate that such person(s) were unable or unwilling to do so. Consequently, the applicant did not satisfy the statutory requirements for a limited grant, and the application was denied.
