The application for stay of execution was dismissed because the execution of the decree regarding the suit property had already been completed prior to the hearing of the appeal, rendering the relief sought nugatory. The applicants' oral request for a stay of payment of costs was not pleaded in their written application, and no grounds were advanced to justify such relief. The court held that parties are bound by their pleadings and cannot present a different case at the hearing. The proper procedure for challenging a decision of a single judge is by reference under Rule 55, which was not followed. As a result, the application was found to be without merit and was dismissed with costs.
