Ratio Decidendi

The plaintiff established an equitable interest in the suit land through a valid sale agreement and possession. The defendant failed to prove lawful acquisition of a Kibanja interest, as there was no evidence of consent from the registered owners as required by section 34 of the Land Act and Regulation 64(2) of the Land Regulations. All purported transactions by the defendant and her predecessors were null and void for lack of such consent. The defendant is therefore a trespasser and has no legal or equitable interest in the suit land. The plaintiff is entitled to vacant possession, a permanent injunction, general damages, and costs. The defendant's counterclaim is dismissed.

Court Disposition

Judgment for the plaintiff. Defendant's counterclaim dismissed with costs.
