The court found that the applicant was not duly served with the Notice of Motion in Miscellaneous Cause No. 26 of 2022. The process server did not leave a copy of the court process with an adult member of the applicant's family, nor was there evidence that the applicant's son was an adult or received the documents. The respondent's contention that service was effected in the same manner as the applicant learned of the order was untenable.
