Procedural Posture

Miscellaneous Application / Ruling

  1. 1 Whether the Chief Magistrate's Court exercised its jurisdiction illegally or with material irregularity and injustice in ordering the attachment and sale of the applicant's cattle.
  2. 2 Whether the High Court should revise the orders of the Chief Magistrate's Court given the lapse of time and potential hardship to affected parties.

Ratio Decidendi

The High Court found that although the applicant's grievance regarding the attachment and sale of his cattle was recognized, the execution of the Chief Magistrate's order had already occurred two years prior. Exercising revisionary powers at this stage would result in serious hardship to several persons, including the bailiff and the purchasers of the cattle, given the practical difficulties in tracing and recovering the cattle. The court emphasized that Section 84 of the Civil Procedure Act prohibits revision where such hardship would result. Consequently, the application for revision was dismissed as moot and impractical.
