Their history of non-compliance and lack of documentary evidence supporting their proprietary claims in the forest reserve further undermined their case. The court found that the applicants were not serious in pursuing their matter and that the absence of both plaintiffs and counsel on the hearing date, without sufficient explanation, did not warrant the exercise of judicial discretion to set aside the dismissal order. The application was therefore dismissed.
