The court found that there was a mistake apparent on the face of the record in the dismissal of Miscellaneous Application No. 16 of 2025, specifically the failure to consider evidence of pending execution in Civil Appeal No. 20 of 2021. This oversight warranted review and the setting aside of the previous ruling to the extent of this error. However, the applicant's requests for a stay of execution regarding both the payment of taxed costs and eviction from the suit land were denied.
