  1. 1 Whether there is good reason for the extension of time within which to make the Application for judicial review or validate the already filed Application.

Ratio Decidendi

The court found that the applicants were unaware of the cancellation of their Certificate of Title until after the statutory time for filing for judicial review had lapsed. The delay was attributable to lack of notification by the respondent and a mistake by the applicants' former counsel in not seeking leave to file out of time. The respondent did not challenge the affidavit evidence, and uncontroverted facts are deemed admitted. The court held that these circumstances constitute good reason for extension of time and validated the already filed application for judicial review. The application was allowed, and the previously filed judicial review application was adopted and validated.
