Ratio Decidendi

The court found that although the subject matter and reliefs sought in both Civil Suit No. 537 of 2021 and Civil Suit No. 0052 of 2023 were the same, Civil Suit No. 537 of 2021 was withdrawn by the respondent prior to the hearing of the present application. As a result, there was no previously instituted suit pending between the parties at the time of the application, and the lis pendens rule did not apply. The application to strike out Civil Suit No. 0052 of 2023 was therefore dismissed.
