Procedural Posture

Application for Leave to Appeal Out of Time / Court of Appeal Decision

  1. 1 Whether ignorance of law, old age, and lack of means constitute sufficient grounds for granting leave to appeal out of time.
  2. 2 Whether an offer of security is relevant before good grounds for extension are established.

Ratio Decidendi

The Court held that ignorance of law, old age, and lack of means do not constitute very special circumstances justifying an extension of time to appeal. The applicant was represented by counsel at trial and expressed an intention to appeal at the time judgment was delivered, negating ignorance as a valid excuse. The offer of security was deemed irrelevant until good grounds for extension were established. The supporting affidavit failed to disclose any exceptional circumstances warranting the reopening of proceedings nearly three years after judgment, especially where property had already passed as a result of the original decision.

Court Disposition

Orders
