Criminal Miscellaneous Application / Ruling on Application for Mandatory Bail

  1. 1 Whether the applicant qualifies for mandatory bail under Article 23(6)(c) of the Constitution after committal to the High Court.
  2. 2 Whether the applicant has met the statutory requirements for release on mandatory bail.

Ratio Decidendi

The court held that the applicant, having already been committed to the High Court for trial on charges of Aggravated Defilement, no longer qualifies for mandatory bail under Article 23(6)(c) of the Constitution. The provision for mandatory bail applies only to accused persons who have been on remand for a continuous period of 180 days and have not yet been committed to the High Court. Since the applicant's committal has occurred, the statutory right to mandatory bail is extinguished, and the application, being specifically for mandatory bail, must fail.
