Miscellaneous Application / Ruling on Application for Adjournment and Interim Order

  1. 1 Whether the application for adjournment should be granted to allow additional parties to be heard.
  2. 2 Whether an interim order restraining the defendants from administering the estate should be issued pending determination of the temporary injunction application.

Ratio Decidendi

The court determined that, in the interest of justice, parties who wish to be joined to the suit should be given an opportunity for their application to be heard. However, since the application for a temporary injunction had already been adjourned previously, the court found it appropriate to issue an interim order restraining the executors from dealing with the estate until the application for a temporary injunction is determined. The application for adjournment was therefore granted, and the proceedings were adjourned sine die, with an interim order in place to preserve the status quo.

Court Disposition

application for adjournment granted; interim order issued

Orders

  • The application for adjournment is granted as requested by counsel for the respondents.
  • The executors are to suspend any dealings in the estate, the subject matter of this application, until the application for a temporary injunction is determined by the court.
