  1. 1 Whether the Plaintiff availed information upon which the Defendant recovered taxes.
  2. 2 Whether the Plaintiff's company Berteen Business Systems Ltd had knowledge of and/or aided tax evasion by Azure Group (U) Ltd.
  3. 3 Whether the Plaintiff is entitled to be paid 10% as informer reward by the defendant.

Ratio Decidendi

The Plaintiff failed to prove on a balance of probabilities that the information he provided led to the recovery of taxes by the defendant. The Tax Evaders Information Form (TIF) was only an acknowledgement of receipt and not conclusive evidence of reliance by the defendant. There was no direct evidence linking the Plaintiff's information to the recovery of tax dues. The Plaintiff also did not prove that his company had knowledge of or aided tax evasion by Azure Group (U) Ltd, and the Defendant failed to strictly plead and prove fraud. As a result, the Plaintiff is not entitled to the informer reward under Section 8 of the Finance Act of 2014. The suit is dismissed with no order as to costs.
