The Supreme Court cannot grant a stay of execution of a Rent Control Board order unless the applicant first applies to the Board, as mandated by rule 5 of the Rules of Court, 1950. Order XLI, rule 4 (1) of the Civil Procedure (Revised) Rules, 1948, is inapplicable because the Rent Control Board is not a court and the rule requires initial application to the court appealed from. The Supreme Court's inherent jurisdiction exists but should not be invoked to circumvent prescribed procedure unless good cause is shown.
