The court held that while Section 67(1) of the Civil Procedure Act confers a general right of appeal against ex parte decrees, this must be read together with the Civil Procedure Rules, which provide a specific remedy for a defaulting defendant: an application to set aside the ex parte decree under Order 9 rule 27. Only if such an application is rejected does a right of appeal arise under Order 44 rule 1(c). The appellant, having failed to attend court despite being present when the matter was fixed for hearing, and not having pursued the proper remedy of setting aside the ex parte decree, cannot rely on Section 67(1) to appeal the merits of the case.
