  1. 1 Whether the plaintiffs/respondents are the lawful owners of the suit kibanja.
  2. 2 Whether the appellant/defendant adduced sufficient evidence of a transaction for the sale of the suit kibanja to his father.
  3. 3 Whether the occupancy of the appellant/defendant on the suit kibanja was lawfully challenged after the demise of their father.

Ratio Decidendi

The appellate court found that the appellant's father, Haruna Lubwama, lawfully acquired the suit kibanja from Badru Lutaya as evidenced by the agreement dated 20/8/1989. The respondents failed to produce any contrary documentary evidence or proof that the occupancy was only temporary or that the respondents' father challenged the appellant's possession during his lifetime. The court determined that there was no dispute between the original parties, and the subsequent challenge by the respondents was not supported by sufficient evidence. Accordingly, all grounds of appeal succeeded, the lower court's decision was set aside, and the appeal was allowed with costs.
