The High Court found that the doctrine of res judicata did not apply to Civil Suit No. 124 of 2018 because the Plaintiffs in that suit were different from those in Civil Suit No. 57 of 2018, and the issues raised were not finally determined on the merits in the earlier ex parte proceedings. The ex parte judgment in Civil Suit No. 57 of 2018 was subsequently set aside, further negating any res judicata effect. The trial Magistrate erred by dismissing Civil Suit No. 124 of 2018 on grounds of res judicata and by denying the Appellants a fair hearing, which occasioned a miscarriage of justice.
