Additionally, the applicant sought validation of an appeal rather than extension of time to file the appeal, which is not provided for in law. The court held that without an application for extension of time, validation of the appeal is not legally tenable. The documents filed in Civil Appeal No.103 of 2022 were therefore filed without legal sanction. The application was found to be bad in law, frivolous, and not compliant with the Civil Procedure Rules.
