Civil Suit / Judgment

  1. 1 Whether each of the plaintiffs is a bona fide purchaser for value for each property for which he or she is registered as proprietor on the respective certificates of title.
  2. 2 Whether the certificate of title known as Mailo Register Volume 152 Folio 12 is valid and legal.
  3. 3 Whether the actions of the Uganda Police Land Protection Unit are in excess of its powers, illegal and arbitrary.

Ratio Decidendi

The court found that each plaintiff is a bona fide purchaser for value without notice of fraud, holding valid certificates of title for their respective plots. The defendants failed to prove any fraud attributable to the plaintiffs or their predecessors in title. The certificate of title known as Mailo Register Volume 152 Folio 12 was converted and legally ceased to exist in 1962; thus, it is not a valid title and cannot support the defendants' claim. Court Disposition

Judgment for the plaintiffs; counterclaim dismissed.
