Miscellaneous Application / Ruling

  1. 1 Whether the letters of administration granted to the Respondent should be revoked due to alleged mismanagement of the estate.
  2. 2 Whether fresh letters of administration should be issued to the Applicants.
  3. 3 Whether the Respondent's name should be removed from the Certificate of Title and replaced with the Applicants as administrators.

Ratio Decidendi

The court found that the estate of the late Tito Byangire had already been distributed to the beneficiaries as per the consent judgment in Kampala HCCS No.36 of 2020. The allegations of mismanagement by the Respondent were rendered moot by the prior distribution of the estate, and there was no remaining property to administer. The application for revocation of letters of administration and issuance of fresh letters was therefore baseless. Additionally, supplementary affidavits filed by the Respondent were struck out for being filed out of time without leave of court. The application was dismissed with no order as to costs.
