The Commission determined that the Complainants had failed to respond to repeated requests for information regarding the progress of negotiations for an amicable settlement and had not requested any extension of the deadline. This prolonged and unjustified lack of response was interpreted as a lack of interest in pursuing the communication. Consequently, the Commission, by majority decision, found that the communication should be struck out for lack of diligent prosecution, in accordance with Rule 113 of its Rules of Procedure. The decision was made to ensure procedural efficiency and uphold the requirement that parties actively pursue their complaints before the Commission.
