There was no evidence of a will prohibiting sale, nor any challenge by the clan during the lifetime of the seller. The Respondents produced valid purchase agreements and witnesses, including clan members, supporting their bona fide purchase. The requirement for spousal consent did not apply at the time of sale, as it was introduced by statute in 1998, after the transactions occurred.
