In this case, the absence of the record of proceedings prevents the court from assessing the likelihood of success of the appeal. However, the possibility that the applicant may serve a substantial part of his sentence before the appeal is heard constitutes an exceptional circumstance favoring the grant of bail. The applicant presented substantial sureties and has previously complied with bail conditions. Therefore, the court exercised its discretion to grant bail pending appeal on specified terms.
