Ratio Decidendi

The court found that the Respondent failed to prove the fundamental breach of contract or its Human Resources Policies and Procedures Manual by the Claimant. There was no evidence of the alleged abusive comments, no record of disciplinary proceedings, and no opportunity given to the Claimant to defend himself. The Respondent disregarded mandatory disciplinary procedures under its own manual and the Employment Act. The urgency claimed by the Respondent did not justify bypassing due process. As a result, the summary dismissal was wrongful and unlawful. The Claimant is entitled to remedies including payment in lieu of notice and general damages.
