The Court of Appeal found that the trial judge properly considered both mitigating and aggravating factors in sentencing the appellant to 35 years' imprisonment for murder. The sentence was within the prescribed range and consistent with previous decisions. Although the trial judge did not arithmetically deduct the period spent on remand, her approach was in line with the prevailing Supreme Court interpretation at the time of sentencing, which only required the period to be taken into account, not deducted.
