The court found that the claimant's appointment letter did not specify a retirement age, nor was any school policy on retirement adduced in evidence. Although the respondent is a government school, the claimant was employed by the board of governors under terms that did not reference government standing orders. The respondent was entitled to restructure staff, but failed to provide the required notice under Section 81 of the Employment Act. The termination was therefore procedurally unfair.
