Ratio Decidendi

The court found that the Defendant unlawfully terminated the Plaintiffs' contracts. For the 1st Plaintiff, the renewal of his contract for only six months, instead of the four years stipulated in the Human Resource Manual, contravened both the Manual and the Employment Act. For the other Plaintiffs, their contracts were terminated without notice or lawful justification, and without any criminal conviction as required by the Defendant's Human Resource Manual. The Defendant relied on an audit report that recommended prosecution, but no prosecution occurred. The court held that the Defendant's failure to follow its own disciplinary procedures and the law rendered the terminations unlawful....
