Ratio Decidendi

The plaintiff was the registered proprietor of Busiro Block 375 Plot 17 from 15/10/1987 until his name was fraudulently cancelled and replaced by the defendant on 2/9/1998. The defendant, having authored the final account of the estate showing the plaintiff as devisee of the disputed land, is estopped from denying this fact. The defendant failed to adduce evidence or challenge the plaintiff's testimony, and the evidence established that the transfer of the property to the defendant was obtained by coercion and was therefore fraudulent. The court found that Plots 17 and 8 are on separate certificates of title, and the plaintiff is entitled to restoration of his ownership and costs.
