The court found that although the Plaintiff and her family resided on the suit property, she failed to prove the existence of a subsisting customary marriage with the 1st Defendant at the time the mortgage transaction was entered into. The dowry was paid after the loan agreement, and no sufficient evidence of a customary marriage ceremony was adduced. Cohabitation alone is insufficient to establish a customary marriage under Ugandan law. Consequently, the 1st Defendant was not required to obtain spousal consent before mortgaging the property.
