Ratio Decidendi

The court found that, following the death of the previous administrator, no family member had come forward to complete the transfer of the estate property to the beneficiaries. The Respondent, being a son and beneficiary of the late Peter Kikomberwa Kasegu, had sold part of his share to the Applicant, but the title remained in the deceased's name. In the interests of justice and to facilitate the effective transfer of the property to the Applicant and other beneficiaries, the court granted the application and appointed the Respondent as the legal representative of the estate with limited letters of administration, specifically for the purpose of registration and transfer of the land title.
